1. Introduction and Agreement

These Terms of Service (“Terms”) govern your access to and use of Financial Tech Wiz and all related services, products, tools, and platforms (collectively, the “Services”).

Financial Tech Wiz (“FTW,” “we,” “us,” or “our”) is operated by Mike’s Marketing Solutions LLC, a California limited liability company.

By accessing, browsing, registering for, or using any part of the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. This agreement is binding and enforceable. Your electronic acceptance, continued use of the Services, or access to any FTW product constitutes acceptance of these Terms.

If you do not agree to these Terms, you must not access or use the Services.

2. Scope of Services

These Terms apply to all Financial Tech Wiz services, whether accessed for free or through paid access, including but not limited to:

The FinancialTechWiz.com website
The Financial Tech Wiz Trading Journal web application
The Financial Tech Wiz Discord community and all channels
Technical scanners, alerts, indicators, and watchlists
Downloadable tools, spreadsheets, templates, and resources
Email communications, newsletters, and notifications
Paid and free access provided through Whop
Any future tools, applications, features, or services offered by Financial Tech Wiz

This scope is intentionally broad and applies to all current and future offerings unless expressly stated otherwise in writing.

3. Eligibility and User Requirements

To use the Services, you must:

Be at least 18 years of age
Have the legal capacity to enter into a binding contract
Use the Services in compliance with all applicable laws and regulations in your jurisdiction

By using the Services, you represent and warrant that your access and use are lawful where you reside.

4. Acceptance of Disclaimer and Risk Disclosures

Your use of the Services is expressly subject to the Financial Tech Wiz Disclaimer, which is incorporated into these Terms by reference.

By using the Services, you acknowledge and agree that:

Financial Tech Wiz does not provide financial, investment, tax, or legal advice
All content and tools are provided for educational and informational purposes only
Trading and investing involve risk, including the potential loss of capital

You agree that you have reviewed and accepted the Disclaimer in full.

Your use of the Services is also subject to the Financial Tech Wiz Privacy Policy, which describes how we collect, use, and share personal information. The Privacy Policy is incorporated into these Terms by reference.

5. Accounts and Access

Some Services require account creation or authenticated access.

You are responsible for:

Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Ensuring your account information remains accurate

Account sharing, resale of access, or allowing unauthorized users to access your account is prohibited unless expressly authorized by Financial Tech Wiz.

Financial Tech Wiz reserves the right to suspend or terminate accounts that violate these Terms or misuse the Services.

6. Trading Journal App Terms

The Financial Tech Wiz Trading Journal App is provided on an “as is” and “as available” basis.

You acknowledge and agree that:

There is no guarantee of uptime, availability, accuracy, or uninterrupted access
All data entered into the app is user provided and not verified by Financial Tech Wiz
You are solely responsible for backing up your data
Financial Tech Wiz is not responsible for data loss, corruption, or deletion
Features, functionality, or access may be modified, suspended, or discontinued at any time

Use of the trading journal is entirely at your own risk.

7. User Generated Content and Data

You retain ownership of any content or data you submit, upload, or enter into the Services, including trade data, notes, messages, and files.

By using the Services, you grant Financial Tech Wiz a non exclusive, royalty free license to store, process, display, and use your content solely for the purpose of operating and improving the Services.

You acknowledge that:

You are responsible for the accuracy and legality of your content
Financial Tech Wiz does not endorse user content
Financial Tech Wiz may remove content that violates these Terms
Anonymized or aggregated data may be used for analytics or platform improvement

8. Scanners, Alerts, and Indicators

Scanners, alerts, indicators, and watchlists identify technical conditions only.

You acknowledge and agree that:

These tools are not trade recommendations
No performance, profitability, or outcome is guaranteed
Alerts may be delayed, inaccurate, incomplete, or unavailable
Market conditions can invalidate technical signals at any time

You remain solely responsible for all trading decisions.

9. Discord Community Rules

The Financial Tech Wiz Discord community is provided for education and discussion.

Prohibited behavior includes, but is not limited to:

Harassment, threats, or abusive conduct
Spam or unsolicited promotions
Financial solicitation or advertising without permission
Impersonation or misrepresentation
Posting illegal or infringing content

Moderation is discretionary. Financial Tech Wiz may mute, remove, or ban users at any time, with or without notice.

Loss of Discord access does not entitle users to refunds or continued access to other Services.

10. Subscriptions, Free Trials, and Billing

Subscriptions, free trials, billing, cancellations, and payments are handled through Whop.

You acknowledge and agree that:

You are responsible for managing your subscription and billing settings
Free trials may convert to paid subscriptions unless canceled
Refunds are governed by Whop’s policies
Financial Tech Wiz does not control payment processor errors, billing failures, or charge disputes

All billing questions must be directed to the applicable payment platform.

For California residents, subscriptions to Financial Tech Wiz services billed through Whop are subject to California’s Automatic Renewal Law (Business and Professions Code section 17600 et seq., “CARL”). By starting a subscription or free trial that converts to paid, you provide express affirmative consent to recurring charges at the price and frequency disclosed at signup. You may cancel at any time through the Whop subscription management page used to initiate the subscription, and we aim to make cancellation no more difficult than signup. Whop sends renewal reminders consistent with CARL requirements.

Refund policies, billing disputes, payment-method updates, and cancellation flows are operated by Whop and governed by Whop’s terms. Direct billing questions to Whop’s support; Financial Tech Wiz cannot directly issue refunds or modify Whop billing records.

11. Third Party Services and Integrations

Financial Tech Wiz relies on third party platforms including, but not limited to, Whop, Discord, TradingView, TrendSpider, and other service providers.

Financial Tech Wiz is not responsible for:

Third party outages or downtime
API changes or feature removals
Pricing or policy changes by third parties

Your use of third party services is subject to their own terms and conditions.

12. Intellectual Property Rights

All content, software, tools, indicators, scanners, designs, and branding are the intellectual property of Mike’s Marketing Solutions LLC unless otherwise stated.

You are granted a limited, non transferable license to use the Services for personal, non commercial purposes only.

You may not:

Copy, reproduce, resell, or redistribute content
Reverse engineer or exploit software or tools
Use trademarks or branding without permission

Unauthorized use may result in legal action.

13. Prohibited Uses

You agree not to:

Use the Services for unlawful purposes
Abuse, scrape, or overload systems
Use automated access without permission
Reverse engineer or bypass security
Impersonate any person or entity

Violations may result in immediate termination.

14. Service Availability and Modifications

Financial Tech Wiz may modify, update, suspend, or discontinue any aspect of the Services at any time.

There is no guarantee that any feature, tool, or access tier will remain available indefinitely.

Continued use of the Services after changes constitutes acceptance of those changes.

15. Termination and Suspension

Financial Tech Wiz reserves the right to suspend or terminate access to the Services at its sole discretion, with or without notice.

Termination may occur for violations of these Terms or misuse of the Services.

No refunds are required for terminations resulting from violations.

Certain provisions of these Terms survive termination, including intellectual property, disclaimers, and limitation of liability.

16. Disclaimers of Warranties

The Services are provided “as is” and “as available.”

Financial Tech Wiz disclaims all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, and non infringement.

No guarantees of results, profits, or performance are made.

17. Limitation of Liability

To the fullest extent permitted by law, Financial Tech Wiz and Mike’s Marketing Solutions LLC shall not be liable for indirect, incidental, consequential, or special damages, including trading or investment losses.

Total liability, if any, shall not exceed the amount paid by you to Financial Tech Wiz during the twelve months preceding the claim.

18. Indemnification

You agree to indemnify and hold harmless Financial Tech Wiz and Mike’s Marketing Solutions LLC from any claims, damages, losses, or expenses arising from:

Your use of the Services
Your violation of these Terms
Your user generated content

19. Governing Law and Venue

These Terms are governed by the laws of the State of California.

Any disputes shall be resolved exclusively in the courts located in Santa Clara County, California.

20. Changes to the Terms

Financial Tech Wiz may update these Terms at any time.

Posting updated Terms constitutes notice. Continued use of the Services indicates acceptance of the revised Terms.

21. DMCA Copyright Notices

Financial Tech Wiz respects the intellectual property of others and expects users to do the same. If you believe content on Financial Tech Wiz infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (“DMCA”).

To be effective, your notice must include:

A physical or electronic signature of the copyright owner or authorized agent
Identification of the copyrighted work claimed to be infringed
Identification of the allegedly infringing material with enough detail to locate it
Your contact information including name, address, telephone number, and email
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner

Financial Tech Wiz may, in its discretion, terminate accounts of repeat infringers.

22. Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved by binding arbitration administered by JAMS or a comparable arbitration service in Santa Clara County, California, in accordance with its rules then in effect.

The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You and Financial Tech Wiz agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative action.

You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your opt-out notice must include your name, email used to access the Services, and a clear statement that you opt out of arbitration.

This section does not preclude either party from seeking injunctive or equitable relief in court for matters relating to intellectual property or unauthorized access to the Services.

23. AI-Assisted Content and Tools

Financial Tech Wiz may use artificial intelligence tools to assist with research, drafting, editing, content production, and product features. Examples include AI-assisted research for blog content, AI-generated chart annotations, and AI-powered insights inside the Financial Tech Wiz Trading Journal App.

Where AI is materially involved in producing a specific piece of content, we aim to label it. Editorial review by a human author remains the standard for content published on the website.

AI outputs may be inaccurate, incomplete, or out of date. You acknowledge that AI-generated content does not constitute financial, investment, tax, or legal advice and is subject to the same limitations described in the Disclaimer.

24. Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in effect.

These Terms and the Financial Tech Wiz Disclaimer constitute the entire agreement between you and Financial Tech Wiz.
